Mountain Pine Beetle Ordinance

Town LandscapeThe Town of Breckenridge is diligent in its efforts to address the devastating effects of the Mountain Pine Beetle to the lodgepole pine forest.

 What property owners need to know.

  • On April 13, 2010, Town Council approved the updated Mountain Pine Beetle Ordinance on second reading. In summary, property owners are required to remove dead and infested lodgepole pine trees each year by July 15. Read the relevant portion of the Town Code here.
  • The Town of Breckenridge will not perform free inspections for the Mountain Pine Beetle on private property. If trees are being marked on private property, it is likely being performed by a Homeowner's Association or its authorized representative.
  • If a property owner questions the accuracy of currently infested trees marked for removal by a third party, the property owner can contact Matt Thompson at (970) 547-3188, for a second opinion.
  • Property owners are responsible for contracting inspection, mitigation, and removal services, as well as all associated costs and fees.
  • A Class D permit is required to remove dead and infested lodgepole pine trees. A Class D permit can be obtained from the Community Development Department. (Exception: If the property owner uses a contractor from the Town of Breckenridge Approved Contractor List, then the Class D permit is waived.)
  • If the property owner would like to remove a different species of tree other than a dead or infested lodgepole pine tree, they MUST receive a Class D permit from the Community Development Department.
  • Property owners are encouraged to become familiar with the signs of infestation, treatment options, and the importance of replanting. See our Frequently Asked Questions for more information.
  • For concerns or complaints about ordinance compliance with a neighboring property, property owners should contact Matt Thompson at (970) 547-3188.
  • For concerns or complaints related to work performed by a contractor, contact the Better Business Bureau.

THE LIST OF APPROVED TREE REMOVAL CONTACTORS HAS BEEN ESTABLISHED BY THE TOWN ONLY FOR THE PURPOSE OF ATTEMPTING TO MAKE CERTAIN THAT TREE REMOVAL CONTRACTORS WORKING WITHIN THE TOWN ARE FAMILIAR WITH THE GOALS OF THE TOWN'S ORDINANCES, RULES AND REGULATIONS. THE TOWN DOES NOT REGULATE THE MEANS, METHODS, TRAINING, EQUIPMENT, OR BUSINESS PRACTICES OF ANY TREE REMOVAL CONTRACTOR, INCLUDING, WITHOUT LIMITATION, THOSE TREE REMOVAL CONTRACTORS ON THE TOWN'S APPROVED LIST. THE TOWN MAKES NO GUARANTEE OR REPRESENTATION WHATSOEVER CONCERNING THE QUALIFICATIONS, EXPERIENCE, ABILITY, COMPETENCE, OR BUSINESS PRACTICES OF ANY TOWN-APPROVED TREE REMOVAL CONTRACTOR. THE TOWN HAS NO LIABILITY TO ANY PERSON WITH RESPECT TO THE WORK OR BUSINESS PRACTICES OF A TOWN-APPROVED TREE REMOVAL CONTRACTOR, AND NO ACTION AT LAW OR IN EQUITY SHALL LIE AGAINST THE TOWN AS A RESULT OF A PERSON BEING PLACED ON OR REMOVED FROM THE DIRECTOR’S LIST OF TOWN-APPROVED TREE REMOVAL CONTACTORS.
