Initiative and Referendum Information
What is an Initiative vs. a Referendum?
A referendum gives town electors the power to require the Town Council to reconsider an ordinance it has passed. A referendum petition must be filed with the Town Clerk within 30 days after the final publication of the ordinance. During this 30-day period, the petition must be signed by at least ten percent (10%) of the electors registered to vote in the last municipal election. Certain types of ordinances cannot be referred.
An initiative gives town electors the power to propose their own ordinance for Town Council consideration and adoption. If the Town Council does not adopt the proposed ordinance, it must be submitted to the town electors for a vote at a municipal election. Initiative proponents have 180 days after the Town Clerk approves the petition form to file a Written Notice of Proposed Ordinance with a petition signed by at least fifteen percent (15%) of the total registered electors in the last municipal election.
